Arizona is one of 42 states with a statutory definition of marriage, having adopted a state “Defense of Marriage Act” (DOMA) in 1996. In 2008, Arizona voters also approved a marriage amendment to the state constitution, making Arizona one of 30 states with such an amendment. Arizona also remains the only state in which voters have rejected a constitutional amendment protecting marriage, with voters having narrowly rejected a constitutional amendment in 2006 after opponents raised concerns about potentially broad unintended consequences of the amendment for unmarried opposite-sex couples.
